- Under section 42 of the DPA 2018, NHS Shetland is required to have an appropriate policy document (APD) in place when processing special categories of personal data for law enforcement purposes which: a. explains NHS Shetland’s procedures for securing compliance with the law enforcement data protection principles (see DPA 2018 s 34(1)); and b. explains NHS Shetland’s policies as regards the retention and erasure of personal data processed, giving an indication of how long such personal data is likely to be retained.
